How Divorce Filing Works

Lakeville residents file at the Dakota County District Court. You start with a Summons and Petition for Dissolution of Marriage. The cost is about $400.

Under § 518.06, Minnesota is no-fault. You state the marriage is irretrievably broken. No other grounds are needed. One spouse files the petition, and the other gets served with the papers.

At least one spouse must have lived in Minnesota for 180 days before filing. The other spouse has 30 days to respond after being served. Uncontested cases can be finalized in a few months. When there are disagreements, the court may order mediation. Contested cases that go to trial take much longer.

Property division follows § 518.58. The court divides things fairly, but not always equally. If kids are involved, custody is based on the best interests of the child under § 518.17. Both parents complete a parenting education class before the decree is finalized.

Fees and Costs

Here are the standard costs for a divorce in Dakota County:

  • Filing the petition: about $400
  • Response fee: $300 to $350
  • Certified copy of decree: $14
  • Uncertified copy: free
  • Process server: $50 to $100
  • Parenting class: $40 to $75

Can not afford the fees? Apply for a fee waiver by filing an In Forma Pauperis petition. You list your income and expenses, and a judge decides. Forms are at the courthouse or online at the Minnesota Judicial Branch website.

The MCRO online search is free for anyone. You do not need to pay anything to look up basic case information through the state portal.

Filing Without a Lawyer

Many Lakeville residents file for divorce on their own, particularly when both spouses are in agreement. The court has resources to help you through the process.

Download forms from the Minnesota Judicial Branch website. All forms are free. File the petition at the Dakota County courthouse (either Hastings or the Apple Valley location). Serve the other spouse. Complete all disclosures. Under § 518.09, the court reviews the agreement before entering the final decree. Even if both sides agree, the judge checks that the terms are fair.

With kids in the case, you need a parenting plan. Both parents take a parenting class. Child support uses the state calculation worksheet. All of these forms and tools are free on the court website. The Dakota County Family Court Self-Help staff at (952) 891-7135 can walk you through the steps.
