Divorce Filing Process

Plymouth residents follow the same process as everyone in Hennepin County. File a Summons and Petition for Dissolution of Marriage at the Family Justice Center. The fee is about $400.

Minnesota is no-fault under § 518.06. The only ground for divorce is irretrievable breakdown of the marriage. You do not need to show fault. One spouse saying the marriage is broken is enough.

One spouse must have lived in Minnesota for 180 days. After filing, the other spouse gets served and has 30 days to respond. Uncontested cases move faster. Contested cases may need mediation or a trial. The court can also order a custody evaluation if there is a dispute about where the kids should live.

Property is divided under § 518.58. The goal is a just and equitable split. Custody follows § 518.17 and the best interests standard. Both parents must take a parenting class if kids are part of the case.

Free public access terminals at the Hennepin County Government Center Skyway let you search case records without needing your own computer or phone.

Filing and Record Fees

Plymouth divorce costs match the Hennepin County fee schedule:

  • Petition filing: about $400
  • Response fee: $300 to $350
  • Certified copy of decree: $14
  • Uncertified copy: free
  • MCRO online search: free
  • Parenting class: $40 to $75

If you can not afford the filing fee, you can file an In Forma Pauperis petition. The court reviews your income and decides if the fees should be waived. Forms are at the self-help center or on the Minnesota Judicial Branch website. Process server costs are separate, usually $50 to $100.

Going Pro Se

Many Plymouth residents handle their divorce without hiring a lawyer. This works well for straightforward cases where both spouses agree. All the forms are free on the Minnesota Judicial Branch website.

File the petition, serve the other party, complete the disclosures, and attend your hearings. Follow every step. Under § 518.09, the court reviews the terms before entering the final decree. A judge signs off even in uncontested cases. If kids are involved, you need a parenting plan and both parents must finish a parenting class.

The self-help center at the Family Justice Center can walk you through each form. They also have guides and checklists that make the process easier to follow. You do not need an appointment for basic help.
